Legal Question in Family Law in Pennsylvania

motion to vacate child support

I have been paying child support regularly and on time. The child has turned 18 and will graduate from high school in june. I have filed a motion to vacate the child support order based on those factors. I thought that in Pa., even if the child decides to go to college, it was deemed unconstitutional to have to continue child support or tuition payments. Can someone please advise me as to the law regarding this issue? Thank you.

Re: motion to vacate child support

You are absolutely correct. In 1995, the Pennsylvania Supreme Court determined that it was unfair to require separated parents to pay child support when intact families are not required to.

Your motion should be granted.
