Legal Question in Immigration Law in Pennsylvania

Early release for inmates scheduled for deportation

I have been told that inmates convicted of a non violent felony and scheduled for deportation can be released early and deported. I can't seem to find any information to verify this.My fiance has served 2 years of a 4-8 sentence. It was his first and only offense and non violent. He has had no write ups during his incarceration. His whole family lives in the US including his son and myself. It's too late to appeal the deportation order so my son and i have no choice but to relocate to a foriegn country. Can anyone verify the information he was given and tell me what i need to do to expedite his deportation.

Re: Early release for inmates scheduled for deportation

You will need the intervention of an attorney to accomplish this, if the government agrees to let him go. What country? What was conviction for? In what state? If this was his first and only offense, and nonviolent, why haven't you sought immigration counsel to advise the consequences. This conviction may not necessarily mean he must be deported if he can obtain relief. Is he married to a U.S. citizen? Are you a citizen? You should really have someone check b/c he may be eligible to file a motion to reopen his deportation case. Depending on the Office of the Chief Counsel, and deportation and removal operations, it may be possible to expedite his removal via a special order by DHS to the state regarding the remainder of his sentence. Go see an immigration attorney who specializes in removal cases; at least get a consultation.
