Legal Question in Medical Malpractice in Pennsylvania

Essure failure

After my last child was born, my husband and I decided that we would have the Essure procedure done. This was an outpatient procedure done in the hospital. My HSG 3 months later confirmed that my tubes were blocked and everything was ok. 3 months after the HSG I started having heavy painful menstrual cycles. An ultra sound was done and again verified my tubes were blocked. 1 month after that I started having sounds like I did when I was pregnant with my other children. I took a home pregnancy test to realize that 7 months after being sterilized I''M pregnant again! Because of health issues with my last child, I was told it was a possible that continuing with this pregnancy would only worsen, and that there was a chance me or the baby would not make it. We decided not to carry on with the pregnancy. I 2 weeks later had both fallopian tubes removed. During that time we discovered that the coil like device migrated to and was found on my uterus. The other half was still found in my fallopian tube. Is this considered a malpractice with the malfuntion of the insert?

Re: Essure failure

There's no way to know if that was malpractice without at least having a qualified health care professional review the medical records. Certainly a lawyer couldn't tell you one way or the other.

Most any plaintiff's medical malpractice attorney would be happy to have a nurse and/or physician review your records free of charge and will represent you if litigation is worth pursuing.

My office can review your case if you'd like; contact me and I'll put you in touch with one of our nurses. Otherwise, you can find attorneys through your local county bar association.

Keep in mind there are time constraints on all medical malpractice cases, typically two years from the incident or discovery of the malpractice. If you wish to pursue your claim, you should seek legal representation promptly.
