Check your own insurance policy. If you have uninsured motorist coverage, yuo should submit the claim to your own insurance company. If you were hurt in tis accident, you should definitely see a lawyer to help you with ths matter.

I'm not sure if you question is just about your car damage, or if you have injuries. On the car damage issue, if you have collision coverage under your ins policy, you should make a claim to your ins co. If you have no collision coverage, you may have a hard time collecting. You can sue the owner & driver in small claims court, but it may be difficult to collect on a judgment. If you were injured & have uninsured motorist coverage on your own ins policy, a claim can be made. I strongly suggest consulting with an experienced injury lawyer. I handle those types of cases. Please feel free to contact me. Good luck!!
