I can't comment on whether the proposed settlement is fair or not but it is your decision as to whether you accept your lawyer's advice or not. If you are unhappy with your lawyer for any reason, whether it is because of lack of communication, comfort level, or anything else, it is your right as a consumer to discontinue the relationship and choose someone else to handle the case. Of course, depending on the circumstances, another lawyer may or may not be interested or willing to take on the case, but you can't be forced to make a decision on your case that you don't want to take. If I were you, I would insist on meeting with the lawyer to discuss the case and the proposed settlement and perhaps the lawyer can explain his or her thoughts to you and why the he/she believes you should settle. If you are not comfortable with the settlement proposed, certainly you should not agree to sign anything until you are satisfied.
