poor water drainage

My neighbor has had an area in his yard where water always seems to run out of but he says it is not a drain.It is next to my driveway and is cracking and washing it away,the water even goes into my basement.I asked him to fix it and he said no because he is not sure where the water is coming from.What do I do to make him fix it?

You asked about water draining from a higher property.

This is a basic problem and doesn't have the solution you would like. Your neighbor probably does not have to do anything to fix the problem. Rather, you need to accommodate the water.

Properties must accept water from a higher property and there is rarely anything that can be done. The best bet is as Glen suggested. Contact your local public works department and see what they can suggest. If you have city water it may be there problem.

Look into it and realize that it's probably your problem to deal with rather than your neighbor's.
