Mortgage prepayment

How can you handle a situation where your lender is trying to charge a prepayment penalty that you did not agree to? The page listing the prepayment penalty amount is not initialed but the page that explains what a prepayment penalty is was signed.

This is dependent upon a review of the contract, but IF you had no notice of the penalty you should not have to pay it. Initialing a page I do not believe will be fatal, if you had actual notice, and the failure to get that page initialed was an oversight.
