Divorce from a US Citizen spouse

Hi. My husband (a USCitizen) & I had finally settled to divorce. He filed the petition for dissolution & I will be served w/ the petition thru mail to sign all the necessary paperworks. Accg to Article 26 of FC, the divorce decree will be recognized in the Phils, thus allowing the spouse living in the Phils to remarry. Do I need to file of a Petition Recognition of the divorce judgement w/ Phils courts to invalidate/cancel our marriage records on file w/ the NSO? Can I still remarry or process my K1 visa w/o filing this Petition Recognition? Shoul I file how long does it takes for the petition to process & what are the steps to cancel records on file w/ the NSO? Please advise. I appreciates any word from you. Thank you po!

You cannot cancel the record of your marriage contract with the NSO. However, what you can do is to have the divorce decree annotated on your marriage contract. This is to serve as notice to the whole world that your marriage bond has been severed.Thus, you can file a petition in court to cause the annotation of the foreign divorce decree on your marriage contract. This is summary in nature and will not take too long.

But you have to engage a legal counsel for this purpose.
