child chooses

if my daughter lives in rhode island with her mom and i live in florida and she wanted to come live with me in florida against her mom's will what would she need to do? she is 8 1/2 yrs old

Hello: I just read your question. Since I do not have all the facts and would have several questions for you, I can only give an overview here. Some of the questions would be: Were you and the mother married? Was there a divorce? What state would that have been in? If no marriage, was there a paternity case? One needs to have a case filed to get before a Judge. You would have to file it up there if nothing has ever been done down here. Of course, I say that based on an assumption that she has lived up there for 6 mos.

If there is a prior case in Fla., you can file a Motion to Modify the custody issue. 'Hope this helps. Tom Rosenblum, Jacksonville
