Legal Question in Family Law in Rhode Island

RI child support student in college lives w/mother

I currently pay child support for my daughter who lives with her mother. She will be 18 and graduate from high schools this year. She will go to college full time in the fall but continue to live with her mother. Will I have to continue to pay support for her while she is in college, living at home? Or will support end at 18 period regardless of her attending college? (Assuming I filed a motion to cease support at 18 yrs old)

Re: Rhode Island (RI) child support student in college lives w/mother

In Rhode Island (RI) Child support continues until your child reaches the age of 18 years old and graduates high school but not longer then the child turning 19. If the child is seriously disabled then it can go until the child is 21. At the Judges discretion, if a motion is filed, the judge can allow child support for 90 additional days. This usally applies if the child is living at home for the summer before college.

Child supprt does not automatically terminate. In Rhode Island, You must file a motion to terminate child support. Otherwise child support will continue to accrue. Please contact myself or a Rhode Island divorce /family law lawyer / attorney.
