Legal Question in Family Law in Rhode Island

seperation

my husband and I recentley seperated because of domestic abuse neither one has served yet What are my husbands responsibilities legally to us financially. Do I have to take him to court or is it something he has to do.Since he is giving me no money for bills will he be held accountable. Thank you

Re: seperation

Although morally your husband continues to be financially responsible for you and your children, legally he is not responsible unless and until there is a court order for child support and spousal support (alimony).

If you are not committed to the idea of a divorce then in Rhode Island you can get a legal separation known as a divorce from bed and board. Be warned however if you do eventually want a divorce then you will have to re-file for a divorce. In essence it costs twice as much to get a separation and then a divorce.

If you have any further questions or wish to proceed with either a separation or divorce please feel free to contact Amy K. D'Alessandro at this office at (401) 353-0440.
