Legal Question in Criminal Law in South Carolina

removal of felony

I was convicted of felony assult and battery in march 2001 in Clarendon County South Carolina, sentenced to 2 years probation. Which I completed in march 2003, i have not been in any other trouble with the law other then this. Sadly I don't have any idea where to start to have this removed, I would love to have this erased as then I would be able to get a decent job and get on with my life.

Re: removal of felony

The expungement laws in SC apply to first offenses in Municipal and Magistrate Courts. What you have described would be a General Sessions charge and therefore would not qualify for an expundement. You should consult with the attorney that represented you to be on the safe side. Also, since the county solicitor's office is the one's that process expungements you can try checking with them.
