changing name on birth certificate

my question is how to change my daughter's last name she has my soon tobe ex-husbands last name and he is not the real father so therefore i want to change it to her real father's last name

In order to change a minor's name, you need to bring an action in family court, which will also require that the other parent be served with notice of the action. There are other requirements, but basically the Court will have to determine if the name change is in the best interest of the minor.
