Legal Question in Family Law in South Carolina

ex husbands name removed from sons birth certificate

I need to know what would be the most efficient way to remove my soon to be ex husbands name from my sons birth certificate. We were not together when he was conceived or born but i was forced to put his name on bc as his father. Please advise.

Re: ex husbands name removed from sons birth certificate

If the child was born during the marriage, then your husband is presumed to be the child's legal father. In order to have that changed, you will need to bring an action naming the actual father so that the Court can make a finding of paternity on that man's part and thus determine that your husband is not the child's father. The Court will not bastardize a child otherwise.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
