Legal Question in Family Law in South Carolina

separation agreement

I recently heard that a seperation agreement is not legal in SC. If this is true I would like to have the wife be responsible for some of the taxes owed by our former business. when the agreement was signed I didn't realize there were outstanding taxes owed. Could I sue her to try to recover some of this?

Re: separation agreement

Separation agreements certainly ARE legal in South Carolina, and the Family Courts approve them every day. If your agreement has not been approved by the Court and is invalid for some reason, then of course all those issues may still be on the table. Likewise, if there were issues that were not addressed in the separation agreement, then those issues might still be able to be litigated now.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case. If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.StevensFirm.com). I wish you the best of luck.
