Legal Question in Family Law in South Carolina

Sepatrate but living with some one else

He is married but has not lived with his wife for 3 years. He would like to move in with me. Will this be a problem when he gets the money to get a divorce?

Re: Sepatrate but living with some one else

His wife may be able to pursue a fault ground divorce against him based on his adultery, but she may be able to do that anyway. If she can prove the adultery, then she can get more of the marital estate and maybe recover her legal and investigative fees. These cases are very fact specific, so it's impossible to tell you more without knowing much more about the facts of his case.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case. If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.StevensFirm.com). I wish you the best of luck.
