Legal Question in Personal Injury in South Carolina

I was in a car accident on this past August 15th. Overview of what happened: I was waiting at my mailbox to make a right turn intoonto my road ( seat belt on, turning signal on, at a complete stop so brake light.was on) but I couldn't turn in because a UPS truck was blocking the road and my neighbor was leaving so he was also.blocking the road. However,.the person who.caused the accident.claims that age was looking at the UPS truck and not me...that's when.she slammed into the.back of me. She was.found at fault and my car is totalled. I was also taken to the hospital because I hit my head on the steering wheel and I was written out of work for 3 days. I guess the reason I'm posting this is because slowly but surely I'm starting to think I need to sue. I'm become aggravated with all the paperwork that I have to fax off and pay for, I was also given a rental car for 7 days and.extended for 2 because my car was totalled. This just isn't ideal because I work full time 3rd shift and as of the 23rd I'll be attending school full time and don't have the time, money and patience to look for a new car. Not to mention my headaches are more often and its uncomfortable to sit at work all night which never happened.before. Someone please help...I need consultantation!

You have a right to be placed into the same position as you were in before the accident. The potential defendant's explanation as to why they did not see you does not matter because in South Carolina, a driver has a legal duty and obligation to keep a proper lookout while operating a motor vehicle. You are entitled to lost wages, appropriate medical care, compensation for personal injury, and monetary compensation for the loss of use of your vehicle (payment for rental vehicle as well as compensation for damage to or replacement of your car).
