I was hit by a big recycle truck 9/11/05. I have had a lot of troblue with Dr's in Sc giving me treatment. I am going to Fl for laser surgery. How long do I have to settle my case? I have heard 5 years, I would like to know how to extend it.

A law suit needs to be filed within 3 years from the date of accident. Under certain circumstances, that time frame is only 2 years if your suing the state or an agency of the state. If you have already filed suit and the case is pending, then you can settle it anytime before an order dismissing it or before having a trial.
