Legal Question in Family Law in South Dakota

child custody

My mother was watching my children for me so i could get on my feet. Now that I am, she wont give them back. She doesnt have custody, not even temporary. Can I just go get them from her? Or do I need to take legal action

as you are the natural guardian of the children, you need not to go to court unless cause of action accurs, what you are require to do, is to amicably try to resolve the issue. if you mom denies to give you the custody then you may go to the court. provided that you have substantial evidence of such denial.
