Legal Question in Family Law in South Dakota

Incorrect names on divorce decree

I am reviewing my divorce decree, and found two errors, and I don't know how important they are.

First, my middle name is spelled incorrectly, and when I tried to change it on my drivers license, I was told that they would have to change it to the incorrect spelling if I didn't get the paperwork fixed.

Then I then found that my ex's first name is correct on the top of the document, but wrong in the middle. His name is Taylor (which is stated at the top of the paperwork). However, this is the line that concerns me: ''It is ordered, adjudged and decreed that the Plaintiff, Travis B. XXXX, be and he is hereby granted an abolute divorce from...... etc). So, I am now, apparently divorced from Travis. But I was married to Taylor.

I was told fixing my name is a quick fix, since it's just one letter that is wrong (Ann vs. Anne), but is his name being completely wrong a big deal?

Thanks for any help!!

Re: Incorrect names on divorce decree

You would have to bring a Motion to corrct clerical errors in the decree or enter into a stipulation and Order wit the other party to correct those errors and amend the decree.
