Legal Question in Criminal Law in Tennessee

Consipiracy to commit assault /juvenile

My stepdaughter has been charged with Consipiracy to commit assault. She was only with the other girls who beat up another teen on school grounds and it is said to be gang related. She isn't in the gang she has just know these girls since elemenary school. Also she happened to have her digital camera on when this occured. She is basically guilty by association. What should she plead on her informal arraignment. and what is the most they can do with her?

Re: Consipiracy to commit assault /juvenile

Your stepdaughter is charged with a crime, she needs a lawyer. If convicted, she could be jailed for the offense for which she is charged. In Tennessee, conspiracy is graded 1 level below the substantive offense which is the subject of the conspiracy. An s assault is a class A Misdemeanor, it sounds like your stepdaughter is charged with a B-misdemeanor which is punishable by up to 6 months in jail and a fine of up to $500.00. In addition, a conviction would be on her record for the rest of her life and used against her in the future. If she is charged as a juvenile, she still may be subject to stiff sanctions and having this charge on her record for the rest of her life.

Do not think that because she was just with these girls when this assault allegedly happened that the state will not proceed against her, they will. Innocence is a conclusion, not a defense. Your stepdaughter needs a lawyer familiar with the criminal system to represent her and protect her rights.
