parent smoking around minor child with asthma

I am interested in learning about any prior child custody cases in Tenn involving a parent smoking around a 3 yr old that has asthma. I have read about a case that was brought in Memphis against a father that had his child (with asthma) around someone else smoking. The mother was awarded full custody pending trial. Do you know of any cases in Tn like this? Would it be against the law to try to get a videotape of this happening? I know the parent is going to deny smoking around the child. The custody is now joint.
