Legal Question in Family Law in Tennessee

Taking my child out of the country

My husband and I are originally from Canada. We've been in TN for 15 years. I want to divorce him and move back to Canada with my child. My child is a U.S. citizen. My husband is a good father, but he works 12 hour days. I don't want to stay in TN anymore. I told my husband he could see our son over the summer. Can I leave the country with my child?

Re: Taking my child out of the country

If your husband agrees in writing you can move to Canada with the child you are okay to do so. Otherwise, I would file for divorce in TN and address the residental schedule of the child. You will have to file for divorce in TN and would recommend doing so before moving to Canada
