Legal Question in Sexual Harassment in Tennessee

Sexual Harassment or Hostile Enviroment

About a year ago I was investigated for sexual harassment at my work. At the beginning of my shift HR called me into a meeting started interrogating me about my working habits and then told me that some of the employees was complaining that I was talking with a co-worker after work in the parking lot was making them feel uncomfortable and not to talk to anyone about it or I would be terminated immediately. Then turned around and asked me if I had any wittnesses. I couldn't ask anyone who had seen us talking for fear of loosing my job. I was then sent back to work after about hour or so. I worked for then next week and a half. My supervisor came up to me and told me that I was suspended for three days while they investigated the accusation. They called me three days later and told me that I was terminated for creating a hostile enviroment. Other employees talk in the parking lot after work also and not fired or complained about. I feel I was singled out. Is there anything legal I can do.

Re: Sexual Harassment or Hostile Enviroment

One of the first issues to be determined is exactly when all of this happened and what has happened since that time. Initially, in Tennessee you have 300 days in which to file a Charge of Discrimination with the Equal Employment Opportunity Commission. If you have not filed a charge within that time, your rights under federal law may be lost forever. Additionally, Tennessee has a separate state law which requires that a lawsuit be filed within 1 year of the date of the adverse employment action. If no lawsuit was filed, your rights under state law may be lost forever.

In order to determine what rights you may have and if you still have time on your statute of limitations, you should schedule a consultation with an experienced labor and employment law attorney.
