Legal Question in Wills and Trusts in Tennessee

wHO GETS TO WHAT OF MOTHERS HOUSE

i just want to know if my half brother, which owns a home can make my brother and i move out of my moms house. (Mom just passed away 2 weeks ago)he says that he wants us to pay him 30,000 dollars which we do not have and that he is going to take us to court. The thing is i am the oldest, and my name is on the deed, not unless mom changed it.I had helped my dad and mom buy that house. There was no will. Should my brother and that r living in moms house be looking for so where to go? I really hate this situation, especially at this time. THANK YOU.

Re: wHO GETS TO WHAT OF MOTHERS HOUSE

I WOULD HAVE TO SEE THE DEED IN ORDER FOR ME TO ACCURATELY TELL YOU. YOUR BROTHER CANNOT FORCE YOU OUT OF THE HOUSE BUT HE CAN FILE A "PARTITION" LAWSUIT AGAINST YOU ASKING THE COURT TO FORCE ALL OF THE OWNERS OF THE REALTY TO SELL IT. IT SOUNDS LIKE HE'D RATHER HAVE THE MONEY THAN THE REALTY. GO DOWN TO YOUR COUNTY REGISTER OF DEEDS OFFICE AND ASK THEM FOR A COPY OF THE LAST DEED OF RECORD TO THE Realty. THEY MAY BE ABLE TO EXPLAIN IT TO YOU.
