Legal Question in Credit and Debt Law in Texas

20 years of interest

My husband has a son from a previous marraige. The son is 20 years old. About 6 years ago we purchased a house together and several months ago we were approved for a loan to put a pool in our backyard. However 3 days before the dig was scheduled the bank calls and said there is a lein against our home. Come to find out an attorney that bought all the debt of a defunct hospital that my step-son was born in had placed a lein on our home. This is becuase a $3000.00 had not been paid from his birth. I believe they tried to get his ex-wife for years to pay but when she filed bankrupcy they went after my husband. We have received almost no information regarding this and when I investigated it with the attorney he was very rude and informed me that with interest for 20 years the bill was now around $20,000!!! I'm at a total loss as to how to handle this. I'm desperate to make this lein go away and I'm willing to pay the original debt amount but I will never be able to pay $20,000 to free my house. Please....any information that you can give me would be most appreciated.

Re: 20 years of interest

I presume that the 20 yr old son was born in TX and that the lien is a hospital lien for the costs of his birth. I would have to look at the paperwork, but there are only certain specific liens that attach to the homestead, and a hospital lien is not one of them. The pool company may refuse to grant you credit because of the lien, but the lien cannot impair your homestead. If you want me to take a look at this matter further, contact me by e-mail for my fax #.
