Legal Question in Criminal Law in Texas

child molestation

My nephew is being held on child molestation. They are doing a DNA on the child, but not my nephew. The officer stated anything comes back from the childs' test, then they will book my nephew in the county, then do a DNA test on him, and he will have to post a bond. That does not make sense to me, Why not do DNA tests on both, before you start charging and booking someone?

I am confused by your statement that he is being held, yet then they will book him.

In any event, the reason is that it is easier for them. My guess would be that they have enough evidence to arrest him -- the outcry, but not enough to convict him.

He needs a lawyer very soon.
