Legal Question in DUI Law in Texas

drunk driving death

My brother was overserved at a bar and was allowed to leave. He drove off a bridge and passed away. The bartender admitted to overserving him and allowing him to leave. She was charged with a crime(not sure what). His girlfriend at the time was 3 months pregnant. Who can sue the bar? My parents or his girlfriend or his son.

Parents and son can sue for wrongful death Possibly girlfriend if there was a common law marriage. His estate can sue.

The parents and the child may sue the driver. The girlfriend may be answer depending on whether or no she meets the qualifications for be common law married to your brother. Otherwise just your parents and your brother's child have the right to file a lawsuit against the bar and bartender.
