How do I pay off a car that is totaled because of a drunk driver?

If you don't have gap insurance, your only real remedy would be to try and sue the drunk driver. You might also try the crime victim compensation fund. You may not qualify for assistance but its worth a shot.

Other than that, only remedies I can think of would be normal financing options. Buy another car and wrap your unpaid balance into the note or get a loan for the difference.

Mr. Tuthill has good advice, and I agree. I just want to add, that it is worth your while to sue him as with the judgment you can get restitution if he gets probation; but you can also block him from getting his license back no matter how compliant he is. Notify the DMV. People will find a way to pay off the debt if they are blocked from getting their license reinstated. Good luck.
