Whether you spent time in jail or not does not matter. If it is a first conviction then the surcharge is $1,000.00 per year, if it is a second, it is $1,500.00; and if there was a breath test, and it was over .16 it is $2,000.00 per year to keep your drivers license. the Surcharge is for three (3) years.
