Legal Question in Family Law in Texas

Who's the boss?

Over 4 mos. ago I filed for uncontested divorce representing myself and have taken every precaution to insure that I adhere to all legal guidelines (hubby in FL); each time that the required timeframe has arrived, I go in only to be denied--no execution notice received; hubby did rec'v citat/petit, I have faxed proof, yet the judge insists on having an executed doc with hubby's answer; my question is, who's the next highest person in command (this judges' boss--fam law)? I feel that I'm being treated without regard since I'm without legal representation; now I stand to loose filing fees, etc.

You would be 100% better off if you would now see a lawyer to get this straightened out for you.

Re: Who's the boss?

You can appeal the Judge's ruling to the appeals court.

However, I also recommend that you have your husband correctly served with the divorce petition. As you have learned, faxed proof is not adequate.

I highly recommend that you retain an attorney to help you finalize this divorce.
