Legal Question in Family Law in Texas

My boy friend was in a serious motorcycle accident, leaving him incapacitated. He is married, but separated since 1989. In the state of Texas, she is legally responsible. Is it possible for her to give me power of attorney to make decisions on her behalf concerning his care.

You could file for guardianship. His wife is the preferred guardian, but under these circumstances, she probably doesn't want it and I think you'd have a good shot of the court granting it. As his guardian, you could get him divorced from her just to get her out of the picture if you needed to.
