Name change of a Minor, with fathers consent

The biological father of my 2 1/2 year old daughter signed a waiver of citation 5 months ago because he was moving out of state and not letting me know where he would be. I am now able to file the Original Petition for Name change. Is the waiver he signed and had notarized 5 months ago still valid?

The waiver was not effective when he signed it. To be effective, a waiver of citation must be signed after the suit is filed. There are exceptions, such as a waiver in a voluntary relinquishment of parental rights.
