Legal Question in Family Law in Texas

Children have been living with paternal grandparents for several years because i was incarcerated. Never signed over rights and there are no public records that they have any form of court appointed custody. How can or should I proceed in trying to get my kids back?

1. Ask them politely when it would be a good time to pick up your children.

2. If they refuse, file an application for writ of habeas corpus. Your lawyer should charge you about $1500 up front for this.
