Legal Question in Family Law in Texas

Cps

If one parent has a case filed does that affect the other parent? My boyfriend found out he had a child in December and the child's mother tested positive for marijuana in October. We have visitation, the case worker told us the case was not filed with us and because we do not reside in the same home as the child. Now, almost 2 weeks later, the case worker is saying we need to have a meeting to see the child. What can we do? Thank you!!

Re: Cps

You state that the child's father has visitation, which means that he has established paternity and conservatorship. CPS should have noticed him, since there are filed court orders regarding the child. Your boyfriend needs to consult with an attorney to determine if his conservatorship should be expanded under these circumstances.
