Decease in Child Support

My daughter's father was ordered to pay $640.00 in child support last May (May 2006). Since then he has become self employed and has filed a motion for a decrease in child support on the claim that he earns less, so much less that he filed a loss on his 2006 tax return. I understand starting a company can be financially trying, but can he really decrease my daughter's child support because he chose to work for himself?

Maybe. It is very difficult to prove what self-employed or cash businesses are making. It is often bogus, but hard (expensive) to prove. Probably some of the loss is tied to depreciation, which the child support judge is not going to consider. Get a lawyer to protect yourself.
