My husband and I separated about three months ago, I moved out on my own and he moved in with his mother. I keep both of our children and he keeps them every other weekend. Last week we had an issue where our daughter stayed with him in the middle of the week, and he called the next day and said that he decided to keep her and quit his job and his parents would pay for everything. I actually was able to get my daughter back just by asking to see her and walking away with her but now his mother has called and asked if they can keep both children this weekend and go and see her parents. I am wondering if I let them keep the kids for the weekend and they decide to keep them until custody is arranged through court, would they be more likely to gain custody of the children because they would already be in their possession at the time of the custody hearing?

Yes, your husband can keep both children until the court resolves the issues. Which is a good reason not to send them back without an order in place. Whether or not it improves his chances for custody depends an many different factors. Maintaining the status quo is one of those factors. So is hiding and secreting the children. Do yourself, and your children a big favor, and hire a lawyer today. The lawyer can get the process moving through the court so that everyone has rules to play by.
