can girlfriend give baby boyfriends last name

My husband had an affair, his girlfriend got pregnant and even though my husband told her he did not want his name on the birth certificate she gave the baby his last name. She was not able to put his name as the father because she was also married and even though she is seperated she is not legally divorced is what the nurses at the hospital told her. They are undergoing paternity testing if child is not his what recourse does he have to have the childs last name changed.

Changing the name on the birth certificate can be part of the order resulting from the paternity testing. Your lawyer can take care of this for you or you can insist that the AG's office make this provision in the order.
