If your husband walked out on you and you cannot afford at this time to start proceedings for divorce and he is on probation for driving suspended license and charges were filed against him for hitting a man in a vehicle because he is legally blind do you have to let him take your children if you feel that it is not safe for them to be with him, people have seen him doing things that are not allowed on his probation. I guess I'm really asking will this later on get me in trouble when we do get a divorce. I'm am a concern mother and I have two girls one three and one seven. And also he doesn't have a permanent place he is staying right now...

If you have no money then there are free (pro bono) attorneys available if you qualify. You need to look on the State Bar of Texas website and see where the pro bono organizations are in your county.

Many churches will help you wlth your legal fees.
There are many non-profits that help people with their legal expenses if they feel that their children will be in danger. I worked at Houston Volunteer Lawyer Lawyers and I saw it happen quietly while I worked there.
If you and your children are in danger of this man then you need to enter a shelter. Yes, it is horrible but it helps you with many programs.
