Seeking a Divorce From Venezuelan Husband

I am in the U.S. illegaly and am seeking a divorce from my husband who was deported to Venezuela. My daughters and I feel safer here without him considering he is abusive. I want to obtain the divorce without having to travel back to Venezuela. Is this possible?

You have access to the courts in TX regardless of your immigration status. As long as you've lived in TX for 6 months and in your county for 3 months, you can file and obtain a divorce. Your husband must be served with the divorce and allowed an opportunity to answer before the divorce will be granted. This part will be expensive, because you have to officially send him the papers in Venezuela.
