Legal Question in Family Law in Texas

my stepdaughter has 4 children. she left 2 children back here in los angeles, to move to texas with boyfriend and the 2 children they have together. the relationship did not work out he will not let her see the children or talk to her children. they are not married. the reason he want let her see the children is because every now and then she smokes marijuana and drinks occasionly she has a job but she dosen't really have a place to live. what is her rights in a case like this.

Has there ever been a court order with regard to the two children they have together?

If not, she needs to apply for a writ of habeas corpus to get her children. It will be heard within ten days.
