Taxes; Retirement

My soon to be ex spouse have been separated and he cashed in on his retirement money to pay for his credit cards and a down payment on a car. I did not see a cent of this money.

In the divorce decree, do I have the right to ask that I do not pay any penalties for next year taxes?

Don't you have a lawyer? The divorce is not final, but still pending? Standing orders prevent a party from doing this. This might have been community property. Why would you be penalized for his withdrawal?
