Can I get charges brought upon me for not paying a payday loan?

Yes, if the authorities believe you never intended to pay it back.

"Charges" refers to a criminal case, but you posted this under civil litigation. The lender can sue you civilly -- and even win -- whether you intended to cheat it or not. If you did, then you would be liable for fraud. And if you didn't, you would still be liable for breach of contract.
