Legal Question in Civil Litigation in Texas

someone took me to small claims court for refund. Plaintiff never showed. Case was dismissed. Plaintiff has now filed a refund check with hot checks division, after case was dismissed. Is this right if I won by default. I no longer owe the plaintiff. How can he file hot check if case was dismissed?

Based on what you have written, it appears that this individual may have attempted a civil action against you and did not show which resulted in the dismissal. The hot check division is a criminal proceeding, which is a very different court process. You should consider speaking with a local law firm to assist you in protecting your rights and interests.
