Recently I was stopped at a red light and was side swipped by another car. The driver of the other car produced a insurance card from a reputabile insurance company. He was driving his parents car. His father came to the accident and told the police and myself that he was fully insured. When I filed a claim for damages and bodily injury, I was advised by his insurance that his parents had signed an excluder that he would not be driving his car and that since he was driving they would not assume libility in the accident. I have a 2009 car and have had neck, shoulder and some back pain since the accident. I am fully covered by my insurance, but dont want to have to pay the deductible. I also do not have rental or uninsured motorist on my policy so I will be out that as well. What can I do to get this resolved in a timely manner

If the driver was excluded, then you can sue him for teh deductible and have his driver's license suspended for failure to maintain financial responsibility. If you need help with this case, please feel free to call my office.
