My legal Rights against insurance Companies

My question is I was in accident in the which second party was found at fault by the Police..The insurance for the second party says they don't have to pay for the damage to my car,because there investigator find me at fault. Neither me our the second party we're ticked at the site..but in the report after their investigation they find the second party at fault for running the light.i have only liabilty on the car I own so how do i get the damages ,the towing and all reimburse if possible..

You should speak with an attorney regarding this matter. Insurance companies will sometimes deny your claim in hopes you will file a claim against your own insurance company. Speak with an attorney regarding the accident and bring copies of all communications: emails, letters, repair quotes, medical bills, towing receipts, etc so he/she can review them.

Your situation proves yet again that insurance companies have no interest in truth or fairness; they just want to get out of paying whenever and wherever they can. The police officer, after making his investigation, speaking with the parties and any witnesses, and surveying the scene, concluded that the other party ran the red light. That should settle it. But because the insurance company knows that they can get away with denying liability and forcing you to hire an attorney, they have made the economic decision that, even if they have to pay later, it is more profitable for them to pay later rather than now. Your only recourse is to hire a lawyer and sue the other driver. So, you see, the so-called "lawsuit explosion" is actually caused by insurance companies refusing to pay legitimate claims. It is tragic that insurance companies think they are in business only to collect premiums and not to pay benefits, but your case is just one more example of that reality.

I'll piggyback on what my peers have already said. Get an attorney as soon as possible and bring all of your paperwork with you. Don't talk to the insurance adjuster any more, it won't do any good at this point.
