Legal Question in Insurance Law in Texas

Recovery of attorney's fees

I settled an insurance claim. My attorney in Texas told me we would settle for mid 100's. The insurance company put the money in a safe haven account, in my name only. My attorney in Texas told me that he has not been paid and that I should have paid him out of my safe haven account.

Am I liable to pay him out of my part of the money? My attorney states that if I don't pay his attorney's fees that he will file criminal charges against me. Is this possible?

You should contact a lawyer admitted in Texas. Bohn Phillips, Esq. at 305-444-5907 is located in Coral Gables and admitted in Texas. You can discuss the details with him.

Re: Recovery of attorney's fees

I must assume you signed a retainer agreement specifying how the attorney is to be paid. I suggest you read it. It is customary, in a negligence matter, for the attorney fee to be paid out of the client's recovery.
