Legal Question in Employment Law in Texas

I am a 59 year old male, and I was recently laid off from my job with a small company with a staff of six employees. The owner has stated that all employees will be recalled when the business situation improves. I strongly anticipate that when a recall does occur, that all current employees will be recalled except myself, and that position will be staffed by a new hire. If that scenario should occur, would I have grounds for a claim or suit in regard to age discrimination?

You would probably have a claim under the age discrimination act (29 USC 621), but this type of lawsuit is massively complicated, and will NOT settle out of court, and you won't find a lawyer who will take it on a contingent fee.
