pro rating check

if an employer pro rates my check do they have to pay me for all the hours that i work. my salary is based on 40 hours but i work 50 a week if i work more than that my hours are changed in the computer. the first time that i did not make 100 hours for the pay period my check was pro rated and not paided for the correct hours. i worked 78.38 hours and only paid for 65. is that legal.

Generally NO...call the Texas Workforce Commission..and the US Department of Labor...or call an employment lawyer who takes cases for employees...we would look at it..but we are in Dallas and would need a retainer..
