Legal Question in Employment Law in Texas

Can you be terminated based on your looks?

I have worked for a major retail company for the last 9 months. They have recently changed their image to ''eyecandy''. They distributed a dvd for all associates to view. This dvd is sexual. It could not be seen on TV. They define eyecandy as ''hot''. It seems they are targeting all store managers who are not eyecandy for termination based on performance issues. The counseling write up could be any store manager in the district however it seems to only pertain to those of us who are not young and eyecandy. Dress code was changed for the one not eyecandy material. Is this legal?

If this new "policy" translates into the termination or demotion, or the failure to hire, older workers, it would violate federal and state law.

No it is not legal. Please email me back and I will explain how to fight back. Remember everyone is eye candy to someone and that someone is a customer. Just a guess but are the initials A & F?
